1 Agreement
This Terms and Conditions of Use agreement (“Agreement”) specifies the terms and conditions that govern your access to and use of the LightStone Law website (“Website”). By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to these terms, please do not use the Website. LightStone Law reserves the right, at its sole discretion, to modify, add, or remove portions of this Agreement at any time. It is your responsibility to check this Agreement periodically for changes. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes.
2 No Attorney-Client Relationship
2.1 Contact Form Submissions and Email Communications
Submitting information through the Website’s contact form or sending an email to our office does not create an attorney-client relationship between you and LightStone Law or any of its attorneys. No attorney-client relationship will be formed unless and until:
LightStone Law has evaluated the potential representation;
LightStone Law has determined that no conflicts of interest exist; and
You and LightStone Law have expressly agreed upon the terms of such representation.
2.2 Our obligations to potential clients are strictly limited to those outlined in the Michigan Rules of Professional Conduct (“MRPC”).
2.3 While no attorney-client relationship is formed through Website communications, we will treat information you provide through the Website as confidential in accordance with MRPC 1.18. However, please be advised that electronic communications may not be secure, and you should exercise caution when transmitting sensitive or confidential information.
3 Not Legal Advice
The information provided on the Website is not intended as legal advice and should not be relied upon as such. The information is provided for general informational purposes only. Legal advice can only be provided after an attorney has had the opportunity to consider the specific facts and circumstances of your case and an attorney-client relationship has been established.

The partners of LightStone Law are responsible for the content on the Website and in any advertising material published by the firm. This disclosure is intended to comply with MRPC 7.2, which governs attorney advertising.
6 Intellectual Property Rights
All content included on the Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of LightStone Law or its content suppliers and is protected by United States and international copyright and intellectual property laws.
7 Limited License to Users
LightStone Law grants you a limited, non-exclusive, non-transferable license to access and make personal use of the Website. This license does not include:
Any resale or commercial use of the Website or its contents;
Any collection and use of any product listings, descriptions, or prices;
Any derivative use of the Website or its contents;
Any downloading or copying of account information for the benefit of another merchant; or
Any use of data mining, robots, or similar data gathering and extraction tools.
8 User Conduct
You agree not to use the Website to:
Violate any applicable local, state, national, or international law;
Harass, threaten, or harm any person or entity;
Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, or otherwise objectionable;
Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
Interfere with or disrupt the Website or servers or networks connected to the Website;
Attempt to gain unauthorized access to any portion of the Website or any other systems or networks connected to the Website; or
Use the Website for any purpose that is unlawful or prohibited by this Agreement.
9 Disclaimer of Warranties
THE INFORMATION ON THIS WEBSITE IS PROVIDED “AS IS,”“AS AVAILABLE,” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, LIGHTSTONE LAW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LIGHTSTONE LAW DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10 Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL LIGHTSTONE LAW BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, EVEN IF LIGHTSTONE LAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THIS AGREEMENT, LIGHTSTONE LAW IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF THE WEBSITE, LIGHTSTONE LAW’S LIABILITY SHALL IN NO EVENT EXCEED $100.00.
11 Indemnification
You agree to indemnify, defend, and hold harmless LightStone Law, its partners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:
Your use of the Website;
Your violation of any term of this Agreement;
Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
Any claim that content submitted by you causes damage to a third party.
This defense and indemnification obligation will survive this Agreement and your use of the Website.
12 Privacy Policy
Your visit to our Website is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.
13 Applicable Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to this Agreement or your use of the Website shall be filed only in the state courts located in Kent County, Michigan, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
14 Severability
If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
15 Waiver
The failure of LightStone Law to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
16 Entire Agreement
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and LightStone Law regarding the Website and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and LightStone Law regarding the Website.
